1. Introduction
Welcome to MirrorGlassFrame ("we," "our," or "us"). These Terms & Conditions ("Terms") rule your engagement with both our yacht rental service and our digital platform found at mirrorglassframe.sbs (the "Service"), operated by MirrorGlassFrame.
When you reserve a yacht or utilize our Service, you consent to be obligated by these Terms. Should you not approve of any portion of these terms, you are not permitted to use the Service.
2. Service Overview
MirrorGlassFrame offers elite yacht rental services, which include, among others:
- Day rentals for yachts
- Evening sea voyages
- Business getaways
- Exclusive celebrations
- Extended period charters
All offerings are pending on both availability and meteorological conditions. We retain the right to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, the following requirements must be met:
- Minimum age of 18 years
- Accurate and up-to-date submission of personal details
- Make a deposit as outlined within your booking confirmation
- Adherence to these Terms & Conditions
3.2 Confirmation
A confirmation of your booking is issued only once payment is received along with our written confirmation. We have the authority to decline to provide service to anyone at our discretion.
3.3 Availability
Charter options are contingent upon both the availability of vessels and suitable weather conditions. We will attempt to accommodate your preferred schedule where feasible.
4. Payment Terms
4.1 Pricing
All prices are stipulated in € and cover all necessary taxes, unless specified otherwise. Prices are volatile and can change without prior notification.
4.2 Payment Schedule
- Initial deposit: 50% of the entire charter cost, payable at the time of reservation.
- Remaining balance: Payable 48 hours before the charter begins.
- Additional fees (if applicable): Payable upon completion of the charter.
4.3 Payment Methods
We accept most credit cards, electronic bank transfers, and certified checks. All payment processing is secured through encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Greater than 72 hours prior to departure: Complete refund minus processing charges.
- Between 24 to 72 hours prior to departure: Refund of 50%.
- Under 24 hours prior to departure: Non-refundable.
5.2 Weather Cancellations
In the case that our captain deems weather conditions to be hazardous, we will propose to:
- Reschedule your charter to an alternative date at no extra cost.
- Issue a full refund should rescheduling be unfeasible.
5.3 Mechanical Issues
If any mechanical issues arise with the assigned vessel, we will make an effort to supply an acceptable substitute. If a replacement is not available, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Heed all directives from the crew.
- Don specialized safety equipment as specified.
- Disclose any medical conditions that could impact their safety.
- Stay within the designated areas on the vessel.
6.2 Prohibited Items
The following items are prohibited on board:
- Containers made of glass
- Unlawful substances
- Firearms or other armaments
- Excessive non-alcoholic beverages (exceeding reasonable consumption)
- Pets (unless given prior consent)
6.3 Conduct
Guests must behave in a courteous manner at all times. A charter may be terminated ahead of schedule, with no refund, in case a passenger's behavior is deemed a safety threat or disrupts the experience for others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the payment you made for your charter. We are not accountable for:
- Personal injuries due to passenger negligence.
- Any loss or damage to personal belongings.
- Non-direct, consequential, or punitive damages.
- Delays triggered by weather or events beyond our control.
7.2 Insurance Coverage
Our vessels and operations are covered by comprehensive marine insurance. It is the responsibility of passengers to ensure they have their own travel and personal insurance coverage.
7.3 Assumption of Risk
By taking part in our charter services, you recognize the innate risks associated with maritime activities and you hold yourself accountable for your safety and wellness.
8. Modifications and Itinerary Changes
We reserve the authority to alter itineraries, routes, or schedules due to factors like weather, safety, or operational needs. We will make all efforts to offer comparable alternative options.
9. Force Majeure
We shall not be held liable for any postponements, cancellations, or changes that are caused by circumstances out of our control, which include but are not limited to:
- Extreme weather conditions
- Natural calamities
- Regulatory enactments
- Port restrictions
- Mechanical malfunctions
10. Privacy and Data Protection
Your private information is treated in line with our Privacy Policy. By using our services, you consent to the gathering and utilization of your data as outlined in our Privacy Policy.
11. Intellectual Property
Our website's content which includes text, visuals, emblems, and pictures, is protected by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derived works is prohibited without our explicit written consent.
12. Governing Law
The governing laws of Monaco preside over these Terms. Any conflicts will be resolved in the courts situated in Monaco-Ville, Monaco.
13. Changes to Terms
We have the right to amend these Terms at our discretion. All adjustments will be displayed on our website with a notice of the revision date. Your continued use of our services reflects acceptance of the amended terms.
